A high-speed crash in Edinburgh between a car and a lorry left the driver of the car dead and his passenger severely injured. It later emerged that the car driver had been smoking cannabis prior to the accident.
The woman passenger suffered a cardiac arrest, a brain injury and severe facial injuries and claimed compensation from the deceased driver's insurers. The insurers sought to limit their liability by claiming that the crash was partly the fault of another driver who they claimed had been racing with the driver who crashed into the lorry. Witnesses stated that the car was travelling well over the legal speed limit when the collision occurred.
The court dismissed the insurers' claims, however. The judge was satisfied that the accident was entirely the fault of the driver who was killed and awarded the passenger more than £3 million in damages for her injuries.
