Police station representation
Having the right advice at the police station is essential to ensure that you do not inadvertently harm your defence. You have the right to free legal advice and representation if you are detained or questioned at a police station and you should speak to a solicitor before you given an interview.
At David W Harris & Co, we routinely provide police station representation. We have team members who are accredited police station representatives with the experience and qualifications to provide expert advice and to protect your interests.
We will take steps to ensure that police do not exceed their authority and work to establish what evidence there is in your case.
Gathering together evidence in your case
As soon as you ask us to represent you, we will start putting together evidence in support of your position. We will also obtain copies of all evidence held by the police and prosecuting authorities to establish the extent of the case against you.
We will work to gather other evidence, such as electronic communications, CCTV and video footage, witness statements and documents.
Our criminal law solicitors are known for their attention to detail, and you can be sure that we will leave no stone unturned in securing all of the available information.
Advising you of your position and the options available to you
Once we know the extent of the evidence and any potential charges, we will give you an honest assessment of your case. We can discuss the options open to you, for example, if you intend to plead guilty, we can look at mitigating factors and the potential reduction in sentence that might be available to you.
If you will be pleading not guilty, we will go through the strengths and weaknesses of your case and look at your defence in detail.
We will also look closely at the way in which your case has been handled to see whether any errors have been made. If the police have not followed the correct procedure or if there is a lack of evidence against you, we may be able to ask for charges to be dropped.
If the offence in question is triable only in the Magistrates’ Court, we can ask that an investigation be ended if no charges are brought within six months.
Putting together a robust defence
If you face an ongoing investigation or you are charged with a criminal offence, we will put together the strongest possible defence on your behalf.
We are known for our good case strategies and will ensure that we secure all available evidence to support your position.
As well as gathering evidence, we will look at the circumstances of the incident to establish exactly what happened and whether you have a defence available to you. There are a number of defences in criminal law that may apply to your case. For example, you may have acted in self-defence, out of necessity or because of a mistaken belief on your part.
Where necessary, we will work with experts in putting together your defence. We will make sure that we stay in touch with you throughout the police investigation so that you know what is happening and what to expect next.
We will make sure that we provide clear explanations and that you understand your situation and the way that your case is being dealt with.
We will work proactively at all times when establishing your defence, moving your case on wherever possible and ensuring that we have the information we need.
We are easy to contact and will always be happy to speak to you to discuss any concerns you may have and to answer your questions. We understand that this is likely to be a very difficult time for you and your family, and you will find us supportive throughout your time with us.
Representation at court
If your case reaches court, we will ensure you are represented by an expert criminal law advocate. We have team members who are qualified to appear in court, including courts requiring higher court advocacy qualifications.
We deal with a full range of criminal law cases and routinely represent clients in Youth Court, the Magistrates’ Court and the Crown Court.
If your case is particularly complex or requires specialist expertise, we can work with experts in the relevant field to ensure you have the representation you need. This could be expert witnesses or advocates.
We know that facing a court hearing is daunting and you will have our support and help throughout. We will ensure that you are thoroughly prepared and that you know what to expect during every aspect of your trial.
We will make sure that the prosecution adheres to the strict rules governing issues like disclosure and the use of witnesses. We will also ensure that any witnesses able to support your defence are available to attend your hearing.
Criminal appeals
If you have been convicted of a criminal offence, we can advise you of the possibility of making an appeal. You may have had inadequate representation from a previous criminal law firm or there could be another reason why your conviction is unsafe.
We will go through the circumstances of what has happened and give you our opinion. As well as an error in evidence or representation, there could be procedural mistakes, such as a failure by the prosecution to disclose evidence, which means that your conviction is unsafe. Alternatively, it may be that fresh evidence has come to light that supports your position.
We will give you a realistic assessment of your situation, provide clear criminal law advice and let you know whether we are confident that you have a sound basis for appeal. If you do, we can lodge an appeal with the relevant court and put together your case for hearing. We will ensure that you are represented by an advocate with criminal appeals experience in the relevant area of criminal law.
We also deal with appeals against sentence for clients who have received a sentence that is wrong in law, wrong in principle, manifestly excessive or whose sentence is substantially higher than a co-accused found guilty of the same offence.
