Serious injury claim time limits
You normally have three years to make a claim for a serious injury or any other type of personal injury.
Exactly when this time limit is counted from will depend on the circumstances, but it is generally the date on which you were aware you were injured due to someone else’s negligence or deliberate action (known as the ‘date of knowledge’). This may be significantly later than when the injuries actually occurred.
There are also various exceptions to the standard three-year time limit that may apply, depending on the situation.
